Why every photographer needs a contract
Even shooting for free for a friend? A contract still matters. It protects both parties by documenting:
- What was agreed to
- When and where
- What happens if things change
- How and when you get paid
Without a contract, disputes have no paper trail. With one, both sides know exactly what to expect.
What every photography contract should include
1. Names and contact information
Full legal names of both parties (you and the client), email addresses, phone numbers, and mailing addresses.
2. Session details
- Date, time, and location
- Session duration
- Type of photography (family, wedding, headshots, etc.)
- Number of photographers/assistants
3. Deliverables
Be specific:
- How many edited photos will be delivered?
- In what format (JPEG, RAW, both)?
- Via what method (gallery link, USB, download)?
- What is the timeline for delivery?
4. Payment terms
- Total fee
- Deposit amount (typically 25–50% of total)
- When the balance is due
- Accepted payment methods
- Late payment consequences
5. Cancellation and rescheduling
- How much notice is required to cancel without penalty?
- Is the deposit refundable?
- What happens if the photographer cancels?
- How many reschedules are allowed?
6. Image rights and usage
- Who owns the copyright? (Typically the photographer)
- Can the photographer use images for portfolio/marketing?
- Can the client print and share images?
- Are there restrictions on resale or commercial use?
7. Liability
- Weather-related cancellations (force majeure clause)
- Equipment failure
- Limits on the photographer's liability
8. Model release
If you plan to use images for marketing, include a clause allowing this — or a separate model release form.
